Bristol Park HOA Board proposes changes to neighborhood bylaws

Message from the president and board of managers:

Bristol Park was built and developed beginning in 1997. At that time, the Homeowners Association was controlled by the developer and builder. The HOA bylaws and CCRs (Covenants, Conditions and Restrictions) were adopted with the developer’s and builder’s needs addressed.

Bristol Park development was completed and filled out in the early 2000’s. Since that time, the CCRs and bylaws have not been changed to reflect the completion of the housing development and transfer majority control to the existing homeowners.

The board of managers has hired an attorney to rewrite/amend the bylaws and CCRs to be more in line with current conditions in the neighborhood. The changes proposed are listed in the attached document. Within the next week, each homeowner should receive a copy of the proposed changes along with a ballot to submit a vote for approval.

To approve the amendments, the ballot needs to be signed by each homeowner on deed and both signatures must be notarized. We will be holding a voting meeting on July 25 at the pool, where your signatures can be notarized and ballot submitted.

I encourage all homeowners to review attached changes and vote to adopt the amendments as proposed. Any questions you may have can be answered at the July 25 meeting at the pool.

The Bristol Park Home Owners Association Board of Managers will meet at 7 p.m. Thursday, April 18 at Communication Federal Credit Union, 100 NE 150th Street.

Bristol Park Homeowner Association Adopts Fines for covenant enforcement

The Bristol Park Homeowners Association Board of Managers on July 19 adopted a fine structure for covenant enforcement. The fine structure will take effect Aug. 1. Letters will be sent to all property owners to educate on the new policy. View bylaws and covenants.

Owners and occupants in violation of the provisions of the Bristol Park Home Owners Association Declaration of Protective Covenants, By Laws, or other rules and regulations and amendments thereto, as adopted by the Board of Managers of the Bristol Park Home Owner Association, will be subject to the following process to enforce compliance:

• Owners who are in violation of the above provisions will be issued a courtesy written notice.

• Owners who continue to be in violation of the above provisions after thirty (30) days from the date of the courtesy letter will be issued a formal written notice of violation (First Recorded Notice).

• In the event a violation is not remedied within thirty (30) days from the date of the First Recorded Notice, Owners will be notified in writing that a fine in the sum of Two Hundred Dollars ($200.00) has been assessed, and that an equal sum shall be assessed each thirty (30) day period thereafter until the violation is rectified.

• If the violation is not remedied within ninety (90) days from the date of the First Recorded Notice, the Board, at its discretion and at the sole expense of the Owner, may remedy the violation by any means allowable under the law.

• Should the Owner receive an additional notice for violation of the same Article and Section within a twelve (12) month period from the date of the First Recorded Notice, the Owner shall be immediately subject to an additional fine of Two Hundred Dollars ($200.00), and that an equal sum shall be assessed each thirty (30) day period thereafter until the violation is rectified.

• These fine(s) shall be in addition to other penalties, charges, fees, attorney and court costs, or for reimbursement of other such expenses as may be incurred by the Board to secure collections associated with a violation.

Pool Rules

  1. The association and lifeguards are not responsible for injury.
  2. Children under 13 must be accompanied by an adult 18  years or older. (13-17yr.  olds must have an unsupervised swim form on file to swim without parent.)
  3. Must be 18  years old to have a  pool  guest.
  4. Limit your pool guests to six. Resident must be present with guests.
  5. One long whistle blast means to clear the water immediately.
  6. A safety break will be taken each hour by swimmers under the age of 18. Swimmers under 18 must remain out of the pool. Time will be designated by life guard.
  7. If you cannot swim, do not enter water above your head.
  8. No diving into water less than 6 foot. All dives are subject to lifeguard approval       before performance.
  9. No running allowed inside the pool fence.
  10. No excessive horseplay in or around the pool.
  11. Ball throwing is not permitted inside the pool fence.
  12. Persons with skin disorder or other infections must not enter the pool.
  13. Glass is not permitted inside the pool fence.
  14. Bicycles and tricycles are not permitted inside the pool fence
  15. Smoking, vaping and tobacco products are not permitted inside the pool fence.
  16. Family appropriate swimwear only. No thongs or speedos.
  17. Swim diapers are required for all children who are not toilet trained.
